Short answer: Compassionate early release of super for medical treatment is available only in limited situations set by law. Treatment must be necessary to treat a life-threatening illness or injury, or to alleviate acute or chronic pain or acute or chronic mental illness, and must not be readily available through the public health system (ATO (opens official site)). Whether any particular weight-loss operation meets that test is an ATO decision on the evidence - not something this website can assess or encourage. Parent guide: early release of super.

Risks and limitations to understand first

ATO medical treatment themes

Summarised from the ATO (confirm on ato.gov.au):

For medical treatment expenses, treatment must be necessary to treat a life-threatening illness or injury, alleviate acute or chronic pain, or alleviate acute or chronic mental illness, and must not be readily available through the public health system (ATO (opens official site)).

You generally need two medical reports; at least one must be from a relevant registered specialist (ATO (opens official site)).

You must also meet residency, unpaid-expense, no-alternative-payment and evidence conditions (ATO eligibility conditions (opens official site)).

We do not translate those rules into a yes/no for gastric sleeve, bypass, balloon or any other procedure. Only the ATO can assess an application.

What we will not say

  • We will not tell you that weight-loss surgery “qualifies” or “doesn’t qualify” in your case
  • We will not provide application help, form checklists tailored to bariatric tourism, or clinic funding pathways
  • We will not treat an overseas package price as a reason to access super
  • We will not use this page to market gastric sleeve or gastric sleeve costs as a super-funded option

Those procedure pages exist for clinical and budgeting context only and are not linked here as a funding path.

Overseas treatment is a separate issue

Even where an Australian medical treatment expense might be considered under compassionate grounds, travelling overseas for surgery raises separate Medicare, insurance and aftercare issues (Smartraveller (opens official site); Medicare overseas; health insurance gaps). Meeting travel logistics does not create a super entitlement.

Independent borrowing information (not a recommendation): Moneysmart personal loans (opens official site). Trip costing without super: trip budget planner.

Where to read the official rules

Frequently asked questions

Can I use my super for a gastric sleeve or bypass?

Only the ATO can decide an application against the legal criteria and your evidence. This site does not assess eligibility and does not recommend withdrawing super for weight-loss surgery.

Does obesity alone mean I qualify?

We do not interpret medical criteria for individual readers. Read the ATO medical treatment pages and speak to your treating specialists and a licensed adviser.

Can I use super for weight-loss surgery overseas?

Do not assume overseas elective treatment fits compassionate grounds. Check the ATO rules. Overseas care also has separate insurance and aftercare risks (Smartraveller (opens official site)).

Should I book surgery before applying?

The ATO recommends waiting for the outcome and receiving payment from your fund before you book treatment you have applied for.
